DOJ slams Newsom’s ‘crass political stunt’ over Trump’s call-up of National Guard amid LA anti-ICE riots

The Department of Justice (DOJ) argues the courts should deny California’s request for a restraining order against the Trump administration over its decision to activate National Guard soldiers in Los Angeles after violent riots broke out over the weekend amid Immigration and Customs Enforcement (ICE) raids in the city.
Democratic leaders in California claim President Donald Trump abused his authority by invoking a provision of Title 10 that allows the president to mobilize the National Guard if an invasion or rebellion is underway.
California Gov. Gavin Newsom, a Democrat, said in a statement Monday that Trump caused the bulk of the rioting because he unnecessarily deployed the military to protect ICE personnel and federal buildings. Newsom also claimed local and state police had the situation under control when Trump spurred chaos by issuing his National Guard proclamation.
Weighing in on the matter a day ahead of a scheduled hearing, the DOJ made its case that Trump had the authority to call on the National Guard’s response.

«In a crass political stunt endangering American lives, the Governor of California seeks to use this Court to stop the President of the United States from exercising his lawful statutory and constitutional power to ensure that federal personnel and facilities are protected,» the DOJ said. «But, under the Constitution, the President is the Commander in Chief of the armed forces, and the President is responsible for ensuring the protection of federal personnel and federal facilities.»
Since Friday, violent rioters who object to ICE’s enforcement of immigration laws have targeted and damaged federal buildings, injured federal personnel and impeded federal functions, the DOJ said.
The Los Angeles Police Department (LAPD) and other state and local law enforcement officials have been unable to bring order to Los Angeles, the DOJ claimed.

The agency also pointed to a comment made by LAPD Chief Jim McDonnell, who said during a news conference that «things have gotten out of control» and warned that «somebody could easily be killed.»
«Evaluating the unrest and threats to the enforcement of federal law that local and state authorities were unable or unwilling to control, the President responded by using the authority vested in him by statute and the Constitution to federalize and deploy the California National Guard to protect federal personnel and property, quell the mobs, and restore order,» the DOJ wrote. «When the situation escalated further, the Secretary of Defense deployed a group of U.S. Marines to further assist.
«The President has every right under the Constitution and by statute to call forth the National Guard and Marines to quell lawless violence directed against enforcement of federal law,» the DOJ continued. «Yet instead of working to bring order to Los Angeles, California and its Governor filed a lawsuit in San Francisco seeking a court order limiting the federal government’s ability to protect its property and officials.»

The DOJ said California’s request would «countermand» the president’s military directives, which would be «unprecedented.»
«On the merits, Plaintiffs’ claims are baseless,» the DOJ said.
Newsom also claimed Trump never consulted with him before activating the National Guard, though the statute does not have such a requirement, the DOJ said.
«It merely directs, as a procedural matter, that the President’s orders be conveyed «through» the Governor,» the DOJ wrote. «They were.»

Historically, courts did not interfere when former President Dwight Eisenhower deployed the military to protect school desegregation, nor did they interfere when former President Richard Nixon deployed the military to deliver the mail during a postal strike.
Ultimately, the DOJ recommended the court deny California and Newsom’s motion for a temporary restraining order or preliminary injunction.
Newsom’s office did not immediately respond to Fox News Digital’s request for comment.

It’s Election Day in California, where a ballot initiative will make a huge impact on next year’s battle for the U.S. House majority whether it passes or fails.
California voters are deciding whether to pass a ballot proposition which would dramatically alter the state’s congressional districts, putting the left-leaning state front-and-center in the high-stakes political fight over redistricting that pits President Donald Trump and the GOP against the Democrats.
California state lawmakers this summer approved a special proposition on the November ballot to obtain voter approval to temporarily sidetrack the state’s nonpartisan redistricting commission and return the power to draw the congressional maps to the Democrat-dominated legislature. Early voting by mail in the contest has been underway for a month.
The effort in California, which could create five more Democratic-leaning congressional districts, aims to counter the passage in the reliable red state of Texas of a new map that aims to create up to five right-leaning House seats. Failure to approve what’s known as Proposition 50 would be a stinging setback for Democrats.

Two-term Gov. Gavin Newsom, who is seen as a likely 2028 Democratic presidential contender, is spearheading the push to pass the proposition.
«If we lose here, we are going to have total Republican control in the House, the Senate and the White House for at least two more years,» Newsom emphasized in a recent fundraising appeal to supporters. «If we win here, we can put a check on Trump for his final two years.»

The push by Trump and Republicans for a rare mid-decade redistricting is part of a broad effort by the GOP to pad its razor-thin House majority to keep control of the chamber in the 2026 midterms, when the party in power traditionally faces political headwinds and loses seats.
Trump and his political team are aiming to prevent what happened during his first term in the White House, when Democrats reclaimed the House majority in the 2018 midterm elections.

Missouri last month joined Texas as the second GOP-controlled state to pass congressional redistricting ahead of next year’s elections. The new map in Missouri is likely to give the GOP another right-leaning seat.
And North Carolina’s Republican-controlled legislature also passed a new map, which is likely to score another congressional seat for the GOP. Republican-controlled Indiana is on deck, with a special legislative session getting underway this week.
But unlike those states, California voters need to weigh in before giving redistricting power back to the legislature in Sacramento.
«Heaven help us if we lose,» Newsom said in a fundraising pitch. «This is an all-hands-on-deck moment for Democrats.»
FIVE KEY 2025 RACES TO WATCH
Proponents and opponents of Proposition 50 raised hundreds of millions of dollars in fundraising, with much of the money being dished out to pay for a deluge of ads on both sides.
One of the two main groups countering Newsom and the Democrats labeled their effort «Stop Sacramento’s Power Grab.»
Getting into the fight was former Gov. Arnold Schwarzenegger, who was the last Republican governor of California.

During his tenure as governor, Schwarzenegger had a starring role in the passage of constitutional amendments in California in 2008 and 2010 that took the power to draw state legislative and congressional districts away from politicians and placed it in the hands of an independent commission.
NORTHERN CALIFORNIA VOTERS WEIGH IN ON PROP 50 REDISTRICTING FIGHT
«That’s what they want to do is take us backwards — this is why it is important for you to vote no on Prop 50,» Schwarzenegger said in an ad against Proposition 50. «Democracy — we’ve got to protect it, and we’ve got to go and fight for it.»
But as Election Day neared in California, the Yes forces had dramatically outraised the No forces, and public opinion polling indicated majority support for the proposition.
Even before Trump initiated his redistricting push, Ohio was under court order to redraw its maps. That could boost Republicans in a one-time battleground state that now leans right.
Republicans in GOP-dominated Florida are also mulling congressional redistricting. And Democrats in heavily blue Maryland are weighing a redistricting push, while the Democrat-controlled legislature in Virginia is already pushing redistricting.

Other states considering altering their maps are Democrat-dominated Illinois and red states Kansas and Nebraska.
Meanwhile, Democrats could possibly pick up a seat in Republican-dominated Utah, due to a new, more competitive map, mandated by a judge.

La ciudad de Nueva York elige a su nuevo alcalde en una elección con una fuerte intervención del presidente estadunidense, Donald Trump.
Es que el líder republicano decidió meterse en los comicios de su ciudad natal y tomó una drástica decisión que llamó la atención de propios y ajenos: llamó a los neoyorquinos a no votar por el candidato republicano.

La jugada estratégica de Trump está amparada en las encuestas, que ubican tercero a Curtis Silwa, el candidato por el partido republicano.
Es por eso que el presidente estadounidense les pidió a los neoyorquinos que voten al exdemócrata Andrew Cuomo, que ahora compite como independiente y que está mejor ubicado en la intención de voto.
El objetivo del jefe de la Casa Blanca es impedir la victoria de Zohra Mamdani, el candidato demócrata de 34 años a quien Trump considera como «un comunista» y un «desastre» para la ciudad.
Trump ya había sugerido que prefería a Cuomo antes que a Mamdani en una entrevista que había dado el domingo, pero por la noche del lunes aceleró y publicó un tuit en el que pedía abiertamente votar por Cuomo y no por el candidato de su partido. En esa misma línea, criticó la ideología del candidato demócrata: “Sus principios han sido probados durante más de mil años, y ni una sola vez han tenido éxito. Preferiría ver a un demócrata, que ha tenido un historial de éxito, que a un comunista sin experiencia y un historial de fracaso completo y total”, agregó.
Luego criticó la trayectoria de Mamdani: “No era nada como legislador, entre los últimos de la clase y, como potencial alcalde no tiene ninguna posibilidad de devolverla a su antigua gloria!”
Fue en ese momento en que lanzó el pedido del “voto útil”: elegir al republicano es desperdiciar el voto y mejor votar por Cuomo.

Por otra parte, el presidente estadounidense amenazó con cortar los fondos a la ciudad en caso de que gane el candidato demócrata: “Si Zohran Mamdani gana las elecciones para alcalde de la ciudad de Nueva York, es muy poco probable que contribuya con fondos federales, aparte del mínimo requerido”.
“Como comunista, esta gran ciudad tiene cero posibilidades de éxito, ¡o incluso de supervivencia! Solo puede empeorar con un comunista al timón, y no quiero enviar, como presidente, dinero. Es mi obligación dirigir la Nación, y es mi firme convicción que la Ciudad de Nueva York será un desastre económico y social completo y total si Mamdani gana”, remarcó.
Trump se involucra fuerte en estas elecciones porque son el primer test electoral importante desde que asumió en enero, lo que daría una temperatura de cómo está el ánimo de los estadounidenses a esta altura, un año antes de las legislativas de 2026.
El presidente está con su popularidad en caída. Según un sondeo reciente de The Washington Post/ABC/Ipsos, el 59% de los estadounidenses dijeron que desaprobaban el manejo de la presidencia por parte de Trump, mientras que el 41% lo aprobaba. Es el mayor porcentaje de desaprobación desde que asumió.
Según un promedio de encuestas de RealClearPolitics, los índices más bajos de su gestión se encuentran en el manejo de la economía (54% de desaprobación), la inflación (un 60% de descontento) y la política exterior, mientras que sus índices mejoran sustancialmente en la inmigración y el combate al delito.
Lo que marcan las encuestas
El presidente está muy pendiente de la votación en su ciudad natal, la metrópolis más grande de Estados Unidos, con 8,5 millones de habitantes.
Primero en las encuestas va el legislador estatal Mamdani, que se autodefine como “socialista democrático”, que era prácticamente un desconocido meses atrás y que sacudió al partido con su triunfo arrasador en las primarias de junio con un programa de transporte público y guarderías gratuitas, viviendas accesibles y supermercados con alimentos baratos, todo subsidiado con mayores impuestos a los multimillonarios.
Su principal rival es el ex gobernador demócrata Andrew Cuomo, a quien Madmani derrotó en las primarias y quien se presenta ahora como independiente.

Las encuestas dan por ganador a Mamdani por amplio margen, pero los últimos sondeos indican que la distancia se acortaba incluso hasta 4 puntos. En la pelea, más lejos, se ubica tercero el republicano Curtis Sliwa, con unos 20 puntos que podían ayudar a un triunfo de Cuomo.
Trump comenzó su campaña contra Mamdani hace tiempo ya, acusándolo de “lunático” y “comunista”. Estos últimos días amenazó con cortar la ayuda federal a Nueva York si ganaba y también con enviar al ejército a patrullar las calles. Pero Mamdani, aunque perdía algo de fuerza, seguía arriba en los sondeos.
