ACLU sues Trump over birthright order as Supreme Court clears path for it to take effect

NEWYou can now listen to Fox News articles!
Hours after the Supreme Court delivered the Trump administration a major victory Friday by ruling lower courts may issue nationwide injunctions only in limited instances, a coalition of liberal legal groups filed a sweeping new class-action lawsuit in New Hampshire federal court. It takes aim at President Donald Trump’s January executive order that redefines who qualifies for U.S. citizenship at birth.
While the justices’ 6-3 ruling leaves open the question of how the ruling will apply to the birthright citizenship order at the heart of the case, Friday’s lawsuit accuses the administration of violating the Constitution by denying citizenship to children born on U.S. soil if their mothers are either unlawfully present or temporarily in the country and their fathers are not U.S. citizens or lawful permanent residents.
The case was brought by the American Civil Liberties Union, ACLU of New Hampshire, ACLU of Maine, ACLU of Massachusetts, Legal Defense Fund, Asian Law Caucus and Democracy Defenders Fund. It seeks to represent a proposed class of children born under the terms of the executive order and their parents.

It is not the first legal challenge to the policy. The same group filed a separate suit in January 2025 in the same court on behalf of advocacy organizations with members expecting children who would be denied citizenship under the order. That case led to a ruling protecting members of those groups and is now pending before the 1st Circuit Court of Appeals, with oral arguments scheduled for Aug. 1.
Friday’s SCOTUS ruling states that lower courts can no longer block federal policies nationwide unless it’s absolutely necessary to give full relief to the people suing. The decision does not say whether Trump’s birthright citizenship order is legal, but it means the order could take effect in parts of the country while legal challenges continue. The court gave lower courts 30 days to review their existing rulings.
«The applications do not raise — and thus we do not address — the question whether the Executive Order violates the Citizenship Clause or Nationality Act,» Justice Amy Coney Barrett said, writing for the majority. «The issue before us is one of remedy: whether, under the Judiciary Act of 1789, federal courts have equitable authority to issue universal injunctions.»
«A universal injunction can be justified only as an exercise of equitable authority, yet Congress has granted federal courts no such power,» she added.
SUPREME COURT TAKES ON BIRTHRIGHT CITIZENSHIP: LIBERALS BALK AT TRUMP ARGUMENT TO END NATIONWIDE INJUNCTIONS

Justice Sonia Sotomayor, in her dissent, suggested plaintiffs could pursue class actions as an alternative.
«Nevertheless, the parents of children covered by the Citizenship Order would be well advised to file promptly class action suits and to request temporary injunctive relief for the putative class pending class certification,» Sotomayor wrote. «For suits challenging policies as blatantly unlawful and harmful as the Citizenship Order, moreover, lower courts would be wise to act swiftly on such requests for relief and to adjudicate the cases as quickly as they can so as to enable this Court’s prompt review.»
The ACLU lawsuit calls birthright citizenship «America’s most fundamental promise» and claims the executive order threatens to create «a permanent, multigenerational subclass» of children denied legal recognition.
«The Supreme Court’s decision did not remotely suggest otherwise, and we are fighting to make sure President Trump cannot trample on the citizenship rights of a single child,» said Cody Wofsy, deputy director of the ACLU’s Immigrants’ Rights Project and lead attorney in the case.

«This executive order directly opposes our Constitution, values, and history,» added Devon Chaffee, executive director of the ACLU of New Hampshire. «No politician can ever decide who among those born in our country is worthy of citizenship.»
The lawsuit cites the 14th Amendment, which provides that «all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens.» It also references the Supreme Court’s 1898 decision in United States v. Wong Kim Ark, which affirmed birthright citizenship for U.S.-born children of noncitizens.
The plaintiffs include individuals from Honduras, Taiwan and Brazil. One mother in New Hampshire is expecting her fourth child and fears the baby will be denied citizenship despite being born in the U.S.
The case is Barbara et al. v. Trump et al., No. 1:25-cv-244, filed in the U.S. District Court for the District of New Hampshire.
«Trump’s executive order directly opposes our Constitution, values, and history and it would create a permanent, multigenerational subclass of people born in the U.S. but who are denied full rights,» said SangYeob Kim of the ACLU of New Hampshire in January.

«Today’s historic decision delivers a decisive rejection of the weaponized lawfare President Trump has endured from leftist activist judges who attempted to deny the president his constitutional authority,» White House spokesperson Liz Huston wrote to Fox News Digital.
«President Trump will continue to implement his America First agenda, and the Trump Administration looks forward to litigating the merits of the birthright citizenship issue to ensure we secure our borders and Make America Safe Again.»

Leavitt unloads on Obama over voter ID push, accuses Dems of ‘panic’

NEWYou can now listen to Fox News articles!
White House press secretary Karoline Leavitt is making an example of former President Barack Obama for encouraging voters and lawmakers to reject adopting national voter ID laws.
«You know how badly the Democrats are panicking when they bring out Obama to spread lies about voter ID,» Leavitt posted to X Thursday. «The fact is that nearly 90% of voters support» voter ID laws, she continued before posting two screenshots showing two polls reflecting Americans support such laws at around 83% support to 84% support.
Leavitt’s comments follow the House passing a massive election integrity overhaul bill Wednesday, which includes requiring voters to show a photo ID when casting ballots in federal elections. The bill overall aims to prevent noncitizens from voting in U.S. federal elections, with all but one Democrat, Rep. Henry Cuellar, D-Texas, voting against it.
Obama was among prominent Democrats encouraging House lawmakers to vote against the measure, claiming it will disenfranchise voters.

«Republicans are still trying to pass the SAVE Act—a bill that would make it harder to vote and disenfranchise millions of Americans,» he posted to X Wednesday evening. «Join @RedistrictAct and tell your member of Congress to vote no.»
Democrats have argued that voter ID laws can disenfranchise eligible voters because they often require specific, current government-issued IDs that may be a struggle to obtain due to costs, paperwork hurdles or limited DMV access. Republicans have rejected that argument, calling the requirement a common-sense safeguards that would boost confidence in elections, while simultaneously noting that most Americans already need IDs for everyday tasks.
In another post, Leavitt shared that Obama presented his own driver’s license to vote in the 2012 election. Obama voted early that cycle and was seen on camera pulling his Illinois driver’s license from his wallet to flash to poll workers.

«Here is Barack Obama showing his photo ID to vote in a past election,» Leavitt posted. «Why are Democrats in Congress so opposed to making this a requirement across the country? Voter ID laws are common sense.»
White House spokeswoman Taylor Rogers added that IDs are frequently used by Americans to buy alcohol or get on a plane, which she said shows the hypocrisy of Democrats pushing against the election security overhaul.

«Barack Obama and the rest of the Democrats think Americans are stupid, which is why they are blatantly lying about the commonsense election integrity provisions in the popular SAVE Act,» Rogers told Fox News Digital.
«Americans need to show ID to buy alcohol, get on a plane, and even get into the Democratic National Convention — but these hypocrite Democrats don’t want voters to show their ID to cast a ballot. Congressional Democrats’ opposition to the SAVE America Act is indefensible and wildly out of step with the views of the American people.»
Fox News Digital reached out to Obama’s office Thursday for comment but did not immediately receive a reply.

Called the SAVE Act, the legislation would additionally require information-sharing between state election officials and federal authorities in verifying citizenship on current voter rolls, as well as enable the Department of Homeland Security to pursue immigration cases if non-citizens were found to be listed as eligible to vote.

If passed, the new requirements could be implemented for the November midterm elections. It must first pass the Senate before it could land on President Donald Trump’s desk.

US forces complete withdrawal from strategic al-Tanf Garrison in Syria

NEWYou can now listen to Fox News articles!
The U.S. military has completed its withdrawal of American forces from al-Tanf Garrison in Syria, U.S. Central Command (CENTCOM) announced Thursday.
The departure, finalized Feb. 11, was carried out as part of a broader shift in U.S. posture in the region under Operation Inherent Resolve, the coalition mission launched in 2014 to combat ISIS.
American troops have maintained a limited presence in the country to support partner forces and prevent the terrorist group from resurging after it was territorially defeated in 2019.
Syria’s Defense Ministry said government forces took control of the al-Tanf base following the U.S. withdrawal and have begun deploying along the country’s borders with Iraq and Jordan, according to the Syrian Arab News Agency, the country’s state-run news outlet.

The ministry said the handover was coordinated with U.S. officials and that Syrian Arab Army units moved in to secure the base and surrounding areas in the tri-border desert region.
The development follows a Pentagon decision in April 2025 to scale back and consolidate U.S. forces in Syria.
Caroline Rose, director of the Crime-Conflict Nexus and Military Withdrawals portfolios at the New Lines Institute, told Fox News Digital that al-Tanf was one of the most strategically important U.S. garrisons in Syria, if not the broader Middle East, as it offered access, insight and intelligence collection along Syria’s borders with Jordan and Iraq.

«This was not only pivotal during the U.S.-led Coalition to defeat the Islamic State, where there was a threat of cross-border offensives and violence, but also proved key to U.S. deterrence efforts against Iran-backed militia networks that operated in Iraq and Syria,» she said. «The U.S. pullout from Al-Tanf is a signal that Washington is now comfortable with where the counter-ISIS fight is and the defeat of Iran-aligned proxy networks in the region, along with Syrian security integration efforts with the [Syrian Democratic Forces].»
Rose added that the departure could be viewed as a setback for Jordan, which has long depended on the U.S. position at al-Tanf to deter adversarial actors in the region.
Despite the withdrawal, U.S. forces remain prepared to counter ISIS threats, CENTCOM said, noting that in the past two months, American forces have struck more than 100 targets in the region and captured or killed more than four dozen ISIS fighters.

The change in posture comes just weeks after U.S. forces transferred 150 ISIS fighters from a detention facility in Hasakah, Syria, to a secure location in Iraq.

Officials indicated in late January that thousands more detainees could also be moved as part of the broader effort to maintain long-term security in the region.

Syria became the 90th member of the Global Coalition to Defeat ISIS, a U.S.-led alliance formed to coordinate international efforts against the extremist group, in November.
Tom Barrack, the U.S. ambassador to Turkey and special envoy for Syria, said Damascus — under interim President Ahmed al-Sharaa — is prepared to assume security responsibilities, including control of ISIS detention facilities and camps, following the 2024 ouster of Bashar al-Assad.
