NYC landlord pleads for help as ‘9-year-squatter’ continues to drain him dry in court saga: ‘Twilight Zone’

EXCLUSIVE: NEW YORK CITY — A Brooklyn landlord says he has been trapped in a nearly decade-long legal nightmare that has cost him hundreds of thousands of dollars in unpaid rent and legal fees, while New York courts repeatedly delay resolution as his tenant continues living in the apartment without making direct rent payments to the landlord.
Thomas Diana, who owns a small eight-unit building in Park Slope, told Fox News Digital he has spent the last nine years trying to remove a woman who originally moved into one of his apartments as a live-in companion for an elderly, disabled tenant.
Court records show the woman moved into the apartment in 2014 after responding to a Craigslist advertisement seeking a live-in companion for the tenant, who later died in 2016.
What followed was nearly a decade of litigation spanning multiple courts and proceedings. After the elderly tenant’s death, disputes arose over the woman’s tenancy status, rent obligations and whether the apartment remained subject to New York rent-stabilization laws as Diana sought unpaid rent and possession of the apartment.

«This has gone on for nine years. Nothing about this is justice,» Diana told Fox News Digital. «Every time the case gets close to resolution, there’s another delay, another lawyer change, another new story.»
Diana says the tenant has changed lawyers at least eight times in the ongoing legal saga, which Diana refers to as a «9-year squatter situation,» although the case technically centers around a dispute over rent stabilization laws with the two sides disputing nearly every aspect of the case.
«It drained my daughter’s college fund,» Diana told Fox News Digital inside his home while wearing a now-outdated T-shirt that says, «Stuck with 8-year-squatter.»
«Now we’re borrowing money to pay for college while this just keeps dragging on. It gets pretty stressful. People think eviction cases are like TV where it takes two weeks. In New York it can take years, and this one has turned into almost a decade.»

Attorneys for the tenant strongly dispute Diana’s characterization of the case, and the tenant at one point sued Diana, claiming the apartment had been improperly removed from rent stabilization protections.
«Mr. Diana’s distortion of the facts in this case is a sad attempt to harass our client out of her rent-stabilized apartment, and he will not be successful,» Casey Gilfoil, an attorney with Brooklyn Legal Services, told Fox News Digital.
Gilfoil said a judge has already ruled Diana improperly removed the apartment from rent stabilization and said the remaining issue before the court is determining the legal rent and any potential damages.
Brooklyn Legal Services also says the tenant has money set aside in escrow pending the court’s final ruling.
Diana pushed back, saying the court did not find that he committed fraud and that he followed the guidance he says he received from New York State Division of Housing and Community Renewal when the apartment was deregulated years before the tenant sued. «The judge ruled there was no fraud,» Diana told Fox News Digital. «She said I incorrectly destabilized the apartment. I did it as they told me to.»
Diana also disputed Brooklyn Legal Services’ claim that the tenant has years of rent saved in escrow, saying the numbers do not add up and that, based on court communications regarding her employment history, it is unlikely she has accumulated «anywhere near» $300,000.
Diana says the occupant’s lawsuit relied on what he describes as a series of shifting and contradictory claims, including allegations that the original elderly tenant was not disabled, that the occupant had been on the lease and that the apartment was illegally deregulated.
During depositions, Diana said his attorney challenged those claims with emails, photographs, rent records and testimony. He contends the allegations did not withstand scrutiny during questioning.
«She got destroyed on all 18 claims,» Diana said. «And once those fell apart, they just made up new ones.»
WASHINGTON POST BLASTS RENT CONTROL AS ‘FAILED POLICY’ THAT LEAVES RENTERS ‘WORSE OFF’ THAN BEFORE
Court stipulations required the occupant to make monthly use-and-occupancy payments, similar to interim rent payments, of roughly $835 per month at one point, but Diana says those payments stopped years ago. He estimates total unpaid rent now ranges between $275,000 and $325,000.
In her deposition, the occupant testified she has not worked full time in years and has limited income, a factor Diana says the courts have effectively allowed to justify continued nonpayment.
Diana, who started a GoFundMe page to help with his financial struggles, says the prolonged case has left him struggling to maintain his building and cover basic expenses, including tuition for his children.
«One apartment out of eight not paying rent wipes out any profit,» Diana said. «Judges talk in terms of months. They don’t talk about what $300,000 actually does to a family.»
He also pointed to an overall problem with the system and described repeated housing court inspections that he says resulted in excessive and duplicative violations, which further delayed proceedings and increased costs.

«They’ll cite you for a paint drip from 20 years ago and call you a slumlord,» Diana said. «Meanwhile, the tenant hasn’t paid rent in nearly a decade.»
Diana says his case highlights what he views as a systemic imbalance in New York’s housing courts that allows bad-faith actors to exploit tenant protections indefinitely.
«They tell you to sell your building. They tell you to accept a buyout, to pay the person who owes you hundreds of thousands of dollars,» he said. «That’s not justice. That’s legalized theft.»
In April, the case was adjourned again until this summer, essentially guaranteeing that the saga will extend into its 10th year.
«This court case has become a Twilight Zone Marathon,» Diana said.

Britain’s Prime Minister Keir Starmer announced Monday that he will resign following a mounting revolt inside the Labour Party after devastating local election losses, the resignation of government ministers and growing pressure from senior members of his own cabinet.
Starmer said he would step down as prime minister and Labour leader after concluding he could no longer unite the party, but is expected to remain in office until a successor is chosen.
«Every decision I’ve taken has been about putting the country I love first. That is why I will resign as leader of the Labour Party. I have spoken to his majesty the king this morning to inform him of my decision,» he said while delivering a statement outside of 10 Downing Street.
Starmer also acknowledged growing opposition within his own party, saying, «The question my party is asking now is whether I am best placed to lead us into the next general election. I have heard the answer of my parliamentary party to that question, and I accept that answer with good grace.»
Starmer said he would remain caretaker prime minister until Labour members choose a new leader in the coming weeks.
The announcement follows weeks of turmoil inside Britain’s ruling party after Labour lost roughly 1,500 council seats and control of more than 25 councils in local elections last month, according to reporting from U.K. outlets. The losses were fueled by major gains from Nigel Farage’s Reform UK party in Labour’s traditional strongholds and by Green Party advances in urban areas.

Starmer’s domestic troubles deepened after a damaging dispute with President Donald Trump over the Iran conflict earlier this year. The British prime minister initially resisted U.S. requests to use British bases during military operations against Iran, prompting Trump to criticize him publicly, saying: «This is not Winston Churchill that we’re dealing with,» on March 3.
But after initially drawing a hard line, Starmer later approved limited defensive cooperation with the U.S., angering anti-war lawmakers inside his own party while still failing to satisfy critics who accused him of indecision and weak leadership.
Public frustration over the episode surfaced in YouGov focus groups and polling commentary, where voters described Starmer as «weak,» «indecisive» and overly reactive to Washington.

The crisis escalated after two Labour ministers resigned publicly and called for a leadership transition.
Jess Phillips resigned from her government role after Starmer reportedly refused to step aside during a cabinet meeting. Phillips said Labour needed leadership with more «gusto» and warned the government was failing to deliver the change voters expected, according to The Guardian.
Miatta Fahnbulleh also resigned and called for what she described as an «orderly transition,» according to U.K. media reports Tuesday.
More than 80 Labour MPs publicly called for Starmer to resign. Steven Swinford, political editor at The Times, wrote on X, «What is striking is the fact that they hail from all wings of the party,» adding that roughly a third were centrists, while others came from Labour’s soft-left and hard-left factions.
John Healey defended Starmer publicly before the resignation announcement, saying, «More instability is not in Britain’s interest. Our full focus must be on security.»

Rusia lanzó un nuevo ataque con misiles y drones contra varias regiones de Ucrania: al menos tres muertos
Al menos tres personas murieron en las últimas horas como consecuencia de ataques rusos contra Ucrania, entre ellas un tripulante egipcio de un buque de carga alcanzado por drones en el mar Negro, según informaron este lunes autoridades ucranianas.
Los bombardeos también causaron víctimas en las ciudades de Zaporizhzhia y Odessa, mientras Rusia reportó la interceptación de cientos de drones ucranianos y el cierre temporal de los cuatro aeropuertos de Moscú.
El viceprimer ministro ucraniano, Oleksi Kuleba, informó que un ataque con drones incendió una embarcación mercante que navegaba bajo bandera panameña en el mar Negro. “Un ataque con drones provocó un incendio en un buque que navegaba bajo bandera de Panamá. Un miembro de la tripulación murió: un cocinero de 58 años, ciudadano de Egipto”, escribió en Telegram.
Según el funcionario, otros ocho marineros abandonaron la nave en una balsa salvavidas. Entre ellos había ciudadanos de Turquía e India. Kuleba señaló que el barco “sufrió daños significativos y perdió condiciones de navegabilidad”.
La Marina ucraniana identificó la embarcación como el carguero turco Victress y precisó que el impacto provocó “un incendio de gran magnitud”.
En un comunicado difundido por Telegram, la fuerza naval sostuvo que “este incidente demuestra una vez más que la Federación Rusa continúa violando las normas del derecho marítimo internacional y representando amenazas para la navegación civil”.
Kuleba también afirmó que otras embarcaciones que navegaban bajo las banderas de Palaos y Belice fueron atacadas por fuerzas rusas, aunque en esos casos no se registraron víctimas.
En paralelo, las autoridades regionales ucranianas informaron de otras dos muertes en territorio del país.
En la región de Zaporizhzhia, en el sudeste de Ucrania, un ataque con drones destruyó viviendas y dejó víctimas civiles. El jefe de la administración militar regional, Iván Fédorov, informó inicialmente que los equipos de rescate buscaban a una mujer atrapada entre los escombros.
“Tres personas resultaron heridas y otra mujer quedó atrapada en una casa en llamas tras un ataque enemigo en Zaporiyia”, escribió el funcionario en Telegram. Horas después confirmó el fallecimiento de la víctima.
“Lamentablemente, se ha confirmado la muerte de una mujer que estaba dentro de una casa destruida por un dron enemigo”, señaló Fédorov.
En la región de Odessa, sobre la costa del mar Negro, las autoridades reportaron la muerte de una persona tras un ataque con misil contra infraestructura civil. El gobernador regional, Oleg Kiper, indicó que las fuerzas rusas lanzaron un misil balístico Iskander durante la noche del domingo contra una instalación agrícola.
Por su parte, el servicio estatal de emergencias de Ucrania informó que el ataque provocó un incendio en una empresa agrícola y dejó otras personas heridas. “Una persona murió como resultado del ataque con misiles de ayer contra infraestructura civil en la región de Odesa. Otras tres personas resultaron heridas”, señaló el organismo.
Los nuevos ataques se produjeron en medio de una intensificación de las operaciones militares entre Moscú y Kiev. Rusia mantiene bombardeos regulares sobre ciudades ucranianas desde el inicio de la invasión a gran escala en febrero de 2022, mientras Ucrania incrementó en los últimos meses sus ataques con drones contra territorio ruso.
Del lado ruso, las autoridades informaron que las defensas aéreas interceptaron una nueva oleada de aparatos no tripulados durante la noche. El Ministerio de Defensa ruso aseguró que sus sistemas antiaéreos destruyeron 301 drones ucranianos en distintas regiones del país.
Como medida de seguridad, las autoridades de aviación suspendieron temporalmente las operaciones en los cuatro aeropuertos de Moscú.

Admirador de Bukele y amigo de Milei: quién es Abelardo de la Espriella, el nuevo presidente de Colomboa
Javier Milei tiene un nuevo aliado en la región. El abogado ultraderechista Abelardo de la Espriella, un outsider mediático como él, ganó este domingo el balotaje frente al izquierdista Iván Cepeda y asumirá como nuevo presidente de Colombia el 7 de agosto próximo.
No fue una sorpresa. Todas las encuestas vaticinaban el triunfo de este polémico abogado, admirador del salvadoreño Nayib Bukele que irrumpió en la política colombiana para barrer a la derecha tradicional del país después de cuatro años de una inédita gestión de izquierda de Gustavo Petro.
Apoyado por Donald Trump, su elección inclina aún más el poder de la derecha en el área después del triunfo de José Antonio Kast en Chile y la casi segura victoria de Keiko Fujimori en Perú. Solo Yamandú Orsi, en Uruguay, y Lula da Silva, que deberá revalidar su gobierno en las elecciones del 4 de octubre en Brasil ante el derechista radical Flavio Bolsonaro, mantienen las banderas de la izquierda democrática.
Quien es Abelardo de la Espriella
De la Espriella tiene 47 años, le dicen El Tigre y no tiene ninguna experiencia en la gestión pública.
Pero en un puñado de años, igual que Milei en la Argentina, posicionó su figura en los medios con un lenguaje entre populista y frontal y con promesas de “mano dura” copiadas del manual de su admirado presidente salvadoreño en un país azotado por la violencia.

El flamante mandatario electo no solo promete imitar las políticas de seguridad de Bukele, que acabó con la inseguridad en su país con un combate drástico a las pandillas que asolaban desde hace décadas su país. En un puñado de años, el salvadoreño encarceló a decenas de miles de supuestos pandilleros sin importarle el tendal de denuncias sobre violaciones a los derechos humanos, torturas y detenciones arbitarias e ilegales.
De las Espriella no solo abrazó las mismas propuestas de seguridad con la creación de megacárceles y el fin al dialogo con los grupos guerrilleros, paramilitares y carteles del narcotráfico, a los que promete “bombardear” desde el primer día. Imitó hasta el estilo estético de Bukele. El mismo corte de pelo, la misma barba, los mismos gestos.

Más allá de su admiración por Milei, De la Espriella quiere ser el nuevo Bukele colombiano.
Liberal en lo económico, pero con posiciones que lo acercan más a la derecha tradicional de su país, propensa a no descuidar la presión popular, el presidente electo es fruto de la nueva dirigencia política que anida en las redes sociales.
Así, hizo campaña en sus cuentas personales, en las que cantó ópera, bailó con su esposa Ana Lucía Pineda y se mostró haciendo flexiones de brazos con alguno de sus cuatro hijos montado en su espalda. Además, adoptó la camiseta de la selección de fútbol como vestimenta oficial, lo que desató protestas y demandas que llegaron a la justicia.
Su irrupción en la política es reciente. Se hizo conocido como abogado en polémicos casos judiciales que conmocionaron el país. La lista es extensa: fue asesor de las paramilitares Autodefensas Unidas en el último proceso de paz y abogado de Alex Saab, operador financiero colombiano-venezolano considerado testaferro de Nicolás Maduro y hoy preso en Estados Unidos.
Pero hay un caso judicial que delineó definitivamente su rasgo polémico. Defendió a David Murcia Guzmán, creador de DMG y acusado de una estafa piramidal que afectó a más de 200.000 ahorristas colombianos con un esquema Ponzi.
Así, su rostro y su nombre irrumpieron en la casa de los colombianos. Después mostró su faceta de personaje mediático frontal y descarnado, como cuando escribió un artículo de opinión en El Heraldo de Barranquilla y llamó a asesinar a Maduro.
“Los venezolanos de bien y la comunidad internacional en pleno deben entender que la muerte de Nicolás Maduro se hace necesaria para garantizar la supervivencia de la República. No se trataría de un asesinato común, sino de un acto patriótico que está amparado por la constitución venezolana y que resulta, por demás, moralmente irreprochable”, escribió entonces. Lo curioso es que entonces aún era el abogado de Saab.

No le salió gratis. Debió renunciar al periódico acosado por el escándalo. Pero al poco tiempo fue por más: publicó el libro “Muerte al tirano”.
De la Espriella aprovechó el impulso que le dieron los medios. En pocos años, como Milei, se convirtió en un personaje conocido en los canales de televisión. Sus posturas radicales y las redes sociales hicieron el resto para convencer a una mayoría de colombianos de buscar una tercera vía entre la derecha tradicional y la izquierda de Petro.
Ahora, Colombia se suma a la Argentina, Chile, Paraguay, Bolivia, Ecuador y (casi con seguridad) Perú, en este giro ideológico a la derecha o la extrema derecha respaldada desde Washington.
